RISK WAIVER AND INDEMNITY
1. I understand that recreational and other activities organised by The Summit Lighthouse Australia (TSLA) as part of this retreat (Retreat) may include, but are not limited to, horse riding, canoeing, abseiling, low and high ropes courses, rock climbing, abseiling, archery, crate climb, giant swing, challenge course, pool games, low-risk caving, bush skills, orienteering, bush walks, campfires, wide games, indoor games, initiatives, free time, swimming, sports, craft activities and other similar activities arranged from time to time (Activities).
2. I acknowledge that the Activities are of their nature inherently dangerous.
3. I agree (and on behalf of my dependant) to comply with all rules and warnings made available by representatives of TSLA and the venue where the Retreat is held (Venue), with respect to the Activities and attendance at the Venue in general, and follow any instructions or directions given by any employees, representatives or agents of TSLA and the Venue representatives.
4. I certify that I am/my dependant is physically fit and has no medical or other condition that would make participation in the Activities more hazardous. If I am/my dependant is pregnant, disabled in any way or has recently suffered an illness, injury or impairment, I should have or did consult a physician before participating in the Activities.
5. I agree (and on behalf of my dependant) not to consume alcohol prior to the Activities or use any medicines or substances that will inhibit my/my dependant’s mental or physical ability to safely and effectively participate in the Activities.
6. I agree that TSLA is not responsible for any personal items or property that is lost, damaged or stolen during the Activities and/or from the Venue generally.
7. I give my consent for TSLA personnel to transport the attendee to and from any camp activity during the Retreat. I agree that; the Retreat leadership and TSLA, shall not be liable for any accidental injury to the me/the dependant, whether on or off the Retreat premises, in rented or other vehicles; and I hereby indemnify and hold and TSLA harmless, assume the risk on behalf of the above-named dependant(s) and waive and release all claims or causes of action against the Retreat leadership, TSLA or its agents in connection herewith. All these conditions herein also apply where I have pre arranged for transport of my dependant to or from the retreat.
8. I understand that TSLA is committed to conducting the Retreat in a safe manner and holds the safety of participants in the highest regard and that TSLA attempts to reduce such risks and insists that all participants follow safety rules and instructions, which are designed to protect the participants’ safety.
9. I am solely responsible for determining if I/my dependant are physically fit and/or sufficiently skilled for the Activities.
10. I recognise and acknowledge that there are risks of physical and other injury to participants in the Activities, and I freely and voluntarily agree to assume the full risk of any and all injuries that I/my dependant may sustain as a result of participation in the Activities.
11. I understand that the nearest medical treatment centre may be 100km or more away from the Retreat and/or Conference site, and may be further when attending off-site activities.
12. I assume all risks and hazards incidental to such participation in the Activities, and I waive and indemnify TSLA, its officers, employees, agents and representatives, for any claim (of any nature) arising out of an injury to my dependant and from any and all claims arising out of or connected with my dependant’s participation in the Activities.
13. I agree to release, and not make any claim (of any nature) against TSLA arising as a result of, or in connection with, my dependant’s participation in the Activities. I also agree to indemnify TSLA, its past and present employees, volunteers and agents from any and all third party claims caused in whole or in part by mine or my dependant’s negligent or intentional acts or omissions.
14. In the event of injury or illness of my dependant, I acknowledge that TSLA will endeavour to contact me on the telephone number/s provided on this form, but in the event of emergency, authorise TSLA to obtain all necessary medical assistance, including ambulance transport and hospital accommodation, and I agree to pay for all related fees and expenses.
15. I understand that this document extends to any liability arising out of or in any way connected with the medical or dental treatment and transportation provided in the event of an emergency and/or injury to my dependant.
16. For the purposes of this form and these clauses the Venue and its agents and representatives are not agents and representatives of TSLA.
RETREAT REGULATIONS
I agree (and on behalf of my dependant) to abide by all Retreat and Venue regulations as outlined in the introductory meeting at the start of the Retreat, the policies given in the confirmation letter or conveyed to me at any time. I understand that failure to do this may ultimately result in my dependant being asked to leave the Retreat early with no refund of the Retreat fees being paid or owing to TSLA. I will arrange to pick up my dependant immediately if this happens.
MEDIA CONSENT
Photographs and videos may be used, in an un-identified form, as part of future TSLA and the Venue’s promotional material and also published on TSLA websites, social media platforms and end-of-camp slideshows and videos. Use of such media content is considered a condition of booking. Please indicate if you do not grant media consent to TSLA.
ACCEPTANCE
I agree to not amend any part of this document. I acknowledge that I have read and fully understood the important information above and agree to the terms of this document. I have filled out all my/my dependant’s details including the health and emergency information to the best of my knowledge. I understand that submitting an application form does not grant acceptance to participate in the retreat.
